One cannot go day to day without being effected by their system of government. The presence of politics is not always obvious to those it affects, but everything one interacts with is affected by politics. Politics can be found as one is driving their car or sitting at home watching television. A simple way to notice politics is to realize it is in your life at all times. The first time I was introduced to politics was when I started playing for Dixie League baseball. In the beginning of the season I viewed my first form of government. The coach was the dictator of the team and we were the followers. He controlled everything form the time we practiced to the position everyone played. We obeyed what he said and he had full control and direction. One had to show the coach if he was worthy to play the desired position. I learned at this time that, though a dictatorship can be effective, this form of government had many flaws. We succeeded as a team, but many times the coach would choose a player based on his personal opinion rather than the one best for the position. The team had one girl and she was outstanding at first base, but the coach often placed her in a position that was seldom active. At this time I realized that a dictatorship was reliant on one persons personal discretion. I followed this form of government for many years due t o my desire to play the game I loved. Upon looking back this experience taught me to look deeper into my own beliefs. Later in life I found politics in the school system. The schools I attended would often run elections for various positions in student government and for other prestigious tittles. The Interview Process Essay I have client, a native of India and her name is Vibhuti. She came here to the United States to find work so that she can help her family out financially and give them a better life. Vibhuti is not able to speak English very well, nor is she familiar with the traditions that we have as Americans. She has two children, ages 5 and 2, and with her broken English, she is having a hard time finding a job. She came to our Organization to seek help in obtaining a job, medical insurance, and help with food as she is still trying to find work to support her needs as well as the needs of her family. Interview Process The first time that I met Vibhuti was during our initial interview. During the interview, I was able to assess vibhuti’s weaknesses and strengths and we were able to talk about her needs, what types of services that she can use and how we can help her. The interview was helpful in giving me more information about her. I was able to explain to Vibhuti our organizations policies as well. After getting to know each other, I went ahead and gave Vibhuti an assessment to figure out what her strengths were as well as what type of job might interest her. The results of the assessment that she was given will be used for our future planning when it comes to finding employment for her. For the food and medical assistance, I was able to gather the information needed from her in order to start some emergency assistantce for Vibhuti and her family immediately. The most challenging part for the both of us, is finding her a job that can support her and her family. The assessment is the second part of the interview process. The last part of the interview would be the closure but we can do the closure once all of Vibhuti’s needs are met, including finding a job. During the interview process, I assured Vibhuti that all of the information she provided to our organization would be kept confidential as part of our confidentiality agreement as well as our commitment to our clients’ privacy.  Everything that Vibhuti had or will say, will be kept confidential unless the information can be used to save someone from harm or even death, a matter of life and death is the only reason that could make her information become more public. In case such a need arises, there is a written consent form that she would also needs to sign, informing her that some information she divulged will be used publicly. Active Listening and Questioning During the Interview Process, I used my skills in active listening to make sure that I heard and understood everything that Vibhuti said. I made sure that Vibhuti seen and felt how interested and invested I was with her problems and how willing I was to help her in any way that I could. I also made sure to keep direct eye contact with Vibhuti as well as give simple responses while she was talking in order for her to be aware that I was indeed listening to everything that she was saying, this also helped her to keep talking and telling me things about her and her family so that I could better understand the situation at hand. There are times when Vibhuti stopped talking because she was gathering her thoughts, I was able to use that time to write down some simple notes about our interview. During the interview, I also used closed and open ended questions. An example of a closed ended question that I asked because I needed a specific answer was: â€Å"how many people are living in your home?† One of the examples of an open ended question that I asked Vibhuti was: What types of feelings and emotions are you experiencing since you have relocated to the United States? By asking her this type of question, it allowed her to elaborate a little more about herself and how she was feeling about everything, this allowed me to narrow down what types of other services that she may be in need of. At times during the interview, there were instances when I was unable to completely understand what Vibhuti was saying, so in order to clarify things, I paraphrased what she said. This not only allowed her to know that I was hearing everything that she was saying as well as give her the chance to help me understand anything that may have been misunderstood. Strength Based Approach The interview that was conducted gave me an idea of what types of services  that Vibhuti will need as well as give me and idea of what her strengths are. After we went over what her strengths and interests were, we were able to formulate a plan that would help her get started in a positive direction to achieve the goals that she desired. Since she will be utilizing her strengths, she said that she felt more confident and she feels that she can do any job that we help find for her. One of Vibhuti’s strengths is her willingness to do whatever it takes to help her family and her eagerness to start right away with meeting her goals. During the interview, I also learned that Vibhuti is fluent in two other languages, this definitely plays a big part in her strengths, and it opens up more doors for her when it comes to obtaining a good job. I can say that the interview that I had with Vibhuti went very well, not only for the client, but for myself as well. I was able to learn more about her Indian culture and open the lines of communication between us in order to start the helping process. Violence on the Tube One Saturday morning many years ago, I was watching an episode of the ‘ Roadrunner' on television. As Wile E. Coyote was pushed off of a cliff by the Roadrunner for the fourth or fifth time, I started laughing uncontrollably. I then watched a ‘Bugs Bunny' show and started laughing whenever I saw Elmer Fudd shoot Daffy Duck and his bill went twirling around his head. The next day, I pushed my brother off of a cliff and shot my dog to see if its head would twirl around.   Ã‚  Ã‚  Ã‚  Ã‚  Obviously, that last sentence is not true. Some people believe that violence on the tube is one of the main factors that leads to real-life violence, but in my opinion, television is just a minor factor that leads to real-life violence and that it is the parents responsibility to teach kids the difference.   Ã‚  Ã‚  Ã‚  Ã‚  According to Rathus in Psychology in the New Millennium, observational learning may account for most human learning (239). Observational learning extends to observing parents and peers, classroom learning, reading books, and learning from media such as television and films. Nearly all of us have been exposed to television, videotapes, and films in the classroom. Children in day- care centers often watch Sesame Street. There are filmed and videotaped versions of great works of literature such as Orson Welles' Macbeth. Nearly every school shows films of laboratory experiments.   Ã‚  Ã‚  Ã‚  Ã‚  But what of our viewing outside of the classroom? Television is also one of our major sources of informal observational learning. According to Sweet and Singh, viewing habits range from the child who watches no television at all to the child who is in front of the television nearly all waking hours. They say that on average, children aged 2 to 11 watch about 23 hours of television per week, and teenagers watch about 22 hours per week (2). According to these figures, children spend less time in the classroom than they do watching television. During these hours of viewing, children are constantly being shown acts of violence.   Ã‚  Ã‚  Ã‚  Ã‚  Why? Simple: violence sells.   Ã‚  Ã‚  Ã‚  Ã‚  People are drawn to violence in films, television dramas, books, professional wrestling and boxing, and reports of crime and warfare. Does violence do more than sell, however? Do media portrayals of violence beget violence in the streets and in the home?   Ã‚  Ã‚  Ã‚  Ã‚  It seems clear enough that there are connections between violence in the media and real violence. In the 1990's, for example, audiences at films about violent urban youth such as Colors, Boyz N the Hood, and Juice have gotten into fights, shot one another, and gone on rampages after the showings.

Competency To Stand Trial

On the night of February 4th, police responded to a call at the home of Mr. and Mrs. Wilson. They had been shot and killed; the only other person in the home was the Wilson’s 25 year old son Edward. Subsequently Edward was arrested and charged with two counts of first degree murder. Edward was found to be incompetent to stand trial; now that he has come to the facility where I work for restoration of competency I am responsible for providing a re-evaluation of competency.Knowing Edward’s past mental issues and suicide attempt a few years back there are many things that I would need to take note of before and during the evaluation process. First I would want to obtain information from Edward’s previous doctors, specifically the one who first had diagnosed Edward and prescribed him his medication; even interview the doctor if possible. To aid in the behavioral research I would want to interview Edward’s school teachers to have record of progress and behavior in school.Also, I would want to review school transcripts to see if there was any deterioration of grades and/or behavior. I would want to interview family members and friends to determine any previous rage or anger issues Edward had previously displayed, besides the one(s) already noted. â€Å"Competency to stand trial, is a legal construct that usually refers to a criminal Defendant’s ability to participate in legal proceedings related to an alleged offense† (Mossman, Noffsinger, Ash, Frierson, Gerbasi, Hackett, Lewis, Pinals, Scott, Sieg, Barry, Wall, Zonana, 2007) or.Can be defined as having the capacity mentally to understand and be aware of what was happening as far as the court proceedings the defendant was involved in, as well as being able to communicate and understand information between attorneys. In order to be considered competent to stand trial there are numerous questions that the defendant would need to be able to answer and/or comprehend. Some example s of these questions would be, does the defendant understand what he or she is being charged with, and does he or she understand why?Does the defendant understand the various verdicts from the outcome of the trial, and the possible consequences of each verdict (Forensic Checklist)? There are many instruments to assist with the evaluation assessment, such as the Competency assessment instrument (CAI). In order to assess Edward and his competency to stand trial I would ask him whether or not he was able to communicate relative information to the attorney about the night in question, I would assess his decision making ability when it related to the crimes Edward was charged with.I would ask Edward if he understood the roles of the defense counsel, the judge, the prosecutor and other players in the trial process. I would assess Edward’s view of the crime and the way others would perceived him if found guilty, whether or not people would be in fear of Edward because of the nature of the crime. I would the ask Edward to describe what happened on the night in question, who was there and the timeline of events of that night; I would see if he understood why the police had arrested him and what led up to the arrest.(Whitlock, Feix, Banner, Gerdes, Santina, Trageser, 2012)Besides the interview questions I would assess and evaluate Edward’s demeanor and the way he upheld his appearance. I would evaluate the hand gestures, if any, facial expressions, how in-depth he thought about the answers to the questions I asked, and his overall actions on the outside, or physically. You can tell a lot about a person with the way they carry themselves, their hygiene for instance can tell you if the person is incapable of caring for himself or maybe they have poor hygiene practices.After assessing Edward’s competency level his awareness and his ability to comprehend reality, I do not think that Edward is competent to stand trial. Given his diagnosis of paranoid sch izophrenia and his inability to control the symptoms without medication, along with his past incidents involving anger, rage and violence I do not think Edward would react in an appropriate manner if he was provoked or just had a violent outburst. Considering the charges of first degree murder I believe for the safety of him and others he should be deemed incompetent to stand trial.Because Edward has been found to be incompetent to stand trial, the court proceedings will be put on hold while her continues to receive treatment until his competency has been restored (Frontline, 2013). I believe with continued treatment including medication taken consistently and counseling and observation Edwards’s competency to stand trial will be restored in a few more months. If I had to choose the theory of criminal behavior that would best conceptualize Edward’s behavior I would choose biological, and psychological. Biological, because his condition that he was diagnosed with is a d isorder of the brain, which is biological?Something in his brain has distorted reality and has made him paranoid, hear see and think things that were abnormal and delusional. These symptoms can be controlled with the use of medication when they are take, and again these points to a biological behavior. I chose psychological because in order for somebody to commit murder there must be something wrong in the way they think. This could be attributed to the biological issue of having a disorder of the brain but I feel if that is the case then biological and psychological factors would go hand in hand.Regardless, either way there is an illness in Edwards’s brain that can be associated with biological factors which would in turn lead to the psychological factors and behaviors. If I was on the stand and the judge asked me to assess Edwards risk of future violence, I would tell him Edward is probably unstable. Taking into consideration his past violent outbursts, the fact that he is on medication that controls symptoms of paranoid schizophrenia and the nature of the crime he is being charged with I would inform the judge there is a strong possibility that Edward could have more violent episodes in the future.I would not be able to say for certain but given the facts I would lean very strongly in the direction of him being a threat to himself and others. For those who have been deemed imp competent to stand trial and are put into inpatient treatment, form specialty groups. These specialty groups while in treatment watch video tapes and are given special instructions on how the court processed works. (Greene, 2012) This is the specialty groups I feel Edward would need to fit into for treatment and counseling and would help restore competency.I am hoping that within a couple months of treatment Edward would be able to stand trial and be fairly tried for the crime committed. After assessing Edward and revaluating his competency I have found that even though he has mental issues and is on medication for his diagnosed issue, restoration of his competency to stand trial is a possibility. There is no fear of malingering in Edward’s case, although if there were an issue with a fear of malingering there are tools to help decipher whether or not an individual is trying to fake an incompetency when it comes it to standing trial.

In the year 2004, the nanotechnology market in the fire segment was 30 billion dollars, and is expected to almost double within a decade of introduction. As molecules can appropriately be modified to make them more fire-resistant, companies around the world are increasingly creating these modifications. Each year the nanotechnology market grows by about 25%. Nanotechnology is also said to be environmentally-friendly. China is said to be the current leader in the use of nanotechnology in fire protection (Innovations Report, 2004). The EPA is also supporting research in the use of nanotechnology for fire protection and safety. In February 2007, the EPA published a White paper on Nanotechnology and considered the same to help in preventing pollution to the environment. The White paper also focused on responsible use of nanotechnology by using recycling of the same and also ensures that the same was not toxic to the populations (EPA, 2007). It is a new science with more recent applications and can be considered to be an extension of work that has been occurring on a microscopic level (micrometer). Processes and products with concrete, steel, glass, and composites are using nanotechnology. The concrete that would be used can be manipulated easily and is more durable, stronger and environmentally-friendly. Steel and glass can become tougher. Once, these materials are stronger, durable, and tougher, and their manipulation is improved, the impact on the environment would also be positive as the materials are more efficient. Not only is the process of manufacture improved by using nanotechnology, but also during actual fabrication or manipulation at the construction site (Mann, 2006). Most of the nanotechnology applications have been held back due to the limitations in costs. Nanotechnology is quite expensive for the modern world to incorporate due to the infancy of technology. With costs of using the same very high and rather very limited applications, many people prefer ignoring nanotechnology, resulting in isolation. Researchers feel that within the next five years, there could be significant use of nanotechnology in the field of constructions and others, such that application of the same would not be so exorbitant. Nanotechnology at the moment requires strong funding for research and motivation. The government needs to take an active role in the same with interest in improving the current environmental degradation. Besides, researchers and the industry need to collaborate more strongly. There should be a strong thirst for innovation such that nanotechnology should be applied with greater force (Mann, 2006). With the introduction of any kind of new technology, importance should be given to the life-cycle of the products, toxicity of the product and exposure that could be occurring to both humans and others in the environment. Role the regulatory bodies, courts and the government can perform (EPA, 2007) Today, the walls of homes and offices have huge amounts of lead in the paints and often this can be toxic during use or disposal. Nanotechnology and nanoengineering can help improve the composition of these materials such that they are less toxic to human health and the environment. Today, the impact of floods and erosion beaches are very critical considering the ill-effects of global warming. By changing the way natural materials function at the nanoscale, their environmental-friendliness can be improved (EPA, 2007). Not only would nanotechnology help in reducing the carbon dioxide levels by changing how the material works at the nanoscale, but also help the way in which a building is using energy (EPA, 2007). The same modification to cement can effectively help in fire protection as spray-on coats. The present cements that are being used are very brittle and need polymers to make them more adhesive. With modifications at the nanoscale to cement, they are stronger, more durable and can tolerate high temperatures when present in coats. Effectively carbon nanotubes (CNT’s) are mixed with cement material to mimic something similar to composites with high strength. Another option instead of using CNT’s is polypropylene which is a cheaper option and can improve fire protection (Mann, 2006). Using nanotechnology, better solar cells can be manufactured that are more efficient and cheaper. Besides, nanotechnology can help in heat recovery and also in treatment of water and air at the building. However, these technologies are not current and scientists are suggesting that they can be used, although we have already woken up to the dawn of the future (EPA, 2007). The self-assembly of buildings can be improved using nanotechnology. Molecules can be designed into complementary shapes such that they produce only minimum energy, which effectively helps in fire prevetion (Mann, 2006). Nanotechnology also plays an important role in fire hazard management and prevention. Today having a nanocomposite as one of the materials present in the flame retardant has been considered an advantage. Cross linked systems that provide polyureas and polyurethane foams seem effective in controlling fires. Another new tool that has been developed to combat flames is confocal microscopy (used in chemical analysis and material testing by collecting the light that is in focus and excluding light out of focus) (Leica, 2010). Previously, all the flame retardant systems had certain toxic components that could harm human life and have a negative effect on the environment. Previously, the open cell structures of the foams prevented stability during fire fighting. Even additives that increase the foam stability would have a negative effect on the environment. As most of these substances are volatile, during fire fighting, the high temperature would cause evaporation of these materials causing more damage to the environment (EPA, 2007). Nanotechnology can also be used to develop nano-electromechanical systems and circuitry that would connect detectors at various places in the buildings. The nano-devices would be effectively embedded into surfaces and would be able to detect fire easily (Mann, 2006). Another application of nanotechnology for fire protection is in nanoclays that can help to lower the rate at which plastics burn as it can increase the char forming abilities and prevents plastics from melting and dripping. When used along with other flame retardants, there is more effective fire retardation (EPA, 2007). Battle of Glendale (Fraysers Farm) - Civil War Battle of Glendale - Conflict Date: The Battle of Glendale was fought June 30, 1862, during the American Civil War and was part of the Seven Days Battles. Armies Commanders Union Major General George B. McClellanapprox. 40,000 men Confederate General Robert E. Leeapprox. 45,000 men Battle of Glendale - Background: Having commenced the Peninsula Campaign earlier in the spring, Major General George McClellans Army of the Potomac stalled before the gates of Richmond in late May 1862 after the inconclusive Battle of Seven Pines. This was largely due to the Union commanders overly-cautious approach and the incorrect belief that General Robert E. Lees Army of Northern Virginia badly outnumbered him. While McClellan remained idle for much of June, Lee relentlessly worked to improve Richmonds defenses and plan a counter strike. Though outnumbered himself, Lee understood his army could not hope to win a protracted siege in the Richmond defenses. On June 25, McClellan finally moved and he ordered the divisions of Brigadier Generals Joseph Hooker and Philip Kearny to advance up the Williamsburg Road. The resulting Battle of Oak Grove saw the Union attack halted by Major General Benjamin Hugers division. Battle of Glendale - Lee Strikes: This proved lucky for Lee as he had shifted the bulk of his army north of the Chickahominy River with the goal of destroying Brigadier General Fitz John Porters isolated V Corps. Attacking on June 26, Lees forces were bloodily repulsed by Porters men at the Battle of Beaver Dam Creek (Mechanicsville). That night, McClellan, concerned about the presence of Major General Thomas Stonewall Jacksons command to the north, directed Porter to fall back and shifted the armys supply line from the Richmond and York River Railroad south to the James River. In doing so, McClellan effectively ended his own campaign as the abandonment of the railroad meant that heavy guns could not be carried to Richmond for the planned siege. Assuming a strong position behind Boatswains Swamp, V Corps came under heavy attack on June 27. In the resulting Battle of Gaines Mill, Porters corps turned back numerous enemy assaults through the day until being forced to retreat near sunset. As Porters men crossed to the south bank of the Chickahominy, a badly shaken McClellan ended his campaign and began moving the army towards the safety of the James River. With McClellan providing little guidance to his men, the Army of the Potomac fought off Confederate forces at Garnetts and Goldings Farms on June 27-28 before turning back a larger attack at Savages Station on the 29th. Battle of Glendale - A Confederate Opportunity: On June 30, McClellan inspected the armys line of march towards the river before boarding USS Galena to view US Navy operations on the river for the day. In his absence, V Corps, minus Brigadier General George McCalls division, occupied Malvern Hill. While the majority of the Army of the Potomac had crossed White Oak Swamp Creek by noon, the retreat was disorganized as McClellan had not appointed a second-in-command to oversee the withdrawal. As a result, a large portion of the army was log-jammed on the roads around Glendale. Seeing an opportunity to inflict a decisive defeat on the Union army, Lee devised an intricate plan of attack for later in the day. Directing Huger to attack down the Charles City Road, Lee ordered Jackson to advance south and cross over White Oak Swamp Creek to strike the Union line from the north. These efforts would be supported by assaults from the west by Major Generals James Longstreet and A.P. Hill. To the south, Major General Theophilus H. Holmes was to aid Longstreet and Hill with an attack and artillery barrage against Union troops near Malvern Hill. If executed correctly, Lee hoped to split the Union army in two and cut part of it off from the James River. Moving forward, the plan quickly began to unravel as Hugers division made slow progress due to downed trees blocking the Charles City Road. Forced to cut a new road, Hugers men did not take part in the coming battle (Map). Battle of Glendale - Confederates on the Move: To the north, Jackson, as he had a Beaver Dam Creek and Gaines Mill, moved slowly. Reaching White Oak Swamp Creek, he spent the day attempting to push back elements of Brigadier General William B. Franklins VI Corps so that his troops could rebuild a bridge across the stream. Despite the availability of nearby fords, Jackson did not force the matter and instead settled into an artillery duel with Franklins guns. Moving south to rejoin V Corps, McCalls division, consisting of the Pennsylvania Reserves, halted near the Glendale crossroads and Fraysers Farm. Here it was positioned between Hooker and Kearnys division from Brigadier General Samuel P. Heintzelmans III Corps. Around 2:00 PM, Union guns on this front opened fire on Lee and Longstreet as they met with Confederate President Jefferson Davis. Battle of Glendale - Longstreet Attacks: As the senior leadership retired, Confederate guns unsuccessfully attempted to silence their Union counterparts. In response, Hill, whose division was under Longstreets direction for the operation, ordered troops forward to attack the Union batteries. Pushing up the Long Bridge Road around 4:00 PM, Colonel Micah Jenkins brigade attacked the brigades of Brigadier General George G. Meade and Truman Seymour, both of McCalls division. Jenkins attack was supported by the brigades of Brigadier General Cadmus Wilcox and James Kemper. Advancing in a disjointed fashion, Kemper arrived first and charged at the Union line. Soon supported by Jenkins, Kemper managed to break McCalls left and drive it back (Map). Recovering, the Union forces managed to reform their line and a seesaw battle ensued with the Confederates attempting to break through to the Willis Church Road. A key route, it served as the Army of the Potomacs line of retreat to the James River. In an effort to bolster McCalls position, elements of Major General Edwin Sumners II Corps joined the fight as did Hookers division to the south. Slowly feeding additional brigades into the fight, Longstreet and Hill never mounted a single massive assault which may overwhelmed the Union position. Around sunset, Wilcoxs men succeeded in capturing Lieutenant Alanson Randols six-gun battery on the Long Bridge Road. A counterattack by the Pennsylvanians re-took the guns, but they were lost against when Brigadier General Charles Fields brigade attacked near sunset. As the fighting swirled, a wounded McCall was captured as he attempted to reform his lines. Continuing to press the Union position, Confederate troops did not stop their assaults on McCall and Kearnys division until around 9:00 that night. Breaking off, the Confederates failed to reach the Willis Church Road. Of Lees four intended attacks, only Longstreet and Hill moved forward with any vigor. In addition to Jackson and Hugers failures, Holmes made little headway to the south and was halted near Turkey Bridge by the remainder of Porters V Corps. Battle of Glendale - Aftermath: An exceptionally brutal battle which included widespread hand-to-hand fighting, Glendale saw Union forces hold their position allowing the army to continue its retreat to the James River. In the fighting, the Confederate casualties numbered 638 killed, 2,814 wounded, and 221 missing, while Union forces sustained 297 killed, 1,696 wounded, and 1,804 missing/captured. While McClellan was roundly criticized for being away from the army during the fighting, Lee fretted that a great opportunity had been lost. Withdrawing to Malvern Hill, the Army of the Potomac assumed a strong defensive position on the heights. Continuing his pursuit, Lee attacked this position the next day at the Battle of Malvern Hill.
